my brother was arrested and charged with murder. prior to this he worked for a very good company (non-union). he asked for a leave of absence and was denied and terminated. durring the trial he was found not guilty and released. he imediatly asked for his job back but was denied. they told him that they were in a slow down mode and could not hire him back. at this time they have 14 temps working and just renewed a huge government contract. is their anything that he can do?

Unfortunately, since he is non-union, he really has no job recall rights -- that is a union contract right, not an at-will right.

The only thing he can do is look for another job or try to unionize the company. If, however, the x-employer gives a negative job reference -- like says, "we fired him because he was charged with murder," then, he just might have a cause of action.

Also, just because he was found "innocent," doesn't mean there isn't a record. The original charge is still on the books. I suggest that he try to have it expunged so that a future employer does not pull it up in a background check.
