Texas- What is evading arrest (in vehicle less than 1 mile) would it be considered a misd. or felony and what is the penalty usually.

If you evade in a vehicle then it is a state jail felony which is punishable anywhere from 6 months to 2 years in state jail or up to 5 years straight probation or 10 years deferred probation. There is also a provision in the penal code under 12.44 that allows you to serve misdemeanor punishment for a state jail conviction. So under 12.44 you'd be looking at anything from 1 day to 1 year in county jail.

If you have no prior criminal history I'd expect a probation offer. If you have history then expect some state jail time.
