My brother in law is going through a divorce and his soon to be ex-wife has posted pictures of my children on her my space page without my knowledge or permission. What are my legal rights in this?

I guess you know now. Have you tried asking her to remove them?

No, because she has a restraining order against my brother in law, and his attorney has advised everyone in his family not to talk to her. She is trying to get sole custody of her children and he is trying to fight it. We are using her website as evidence of an affair she is having, and we dont want her to know we are monitoring her website.

What is wrong with the pictures are they pornographic or something:confused:

This would be a ridiculous battle to fight.

Well, for the most part they are not pornographic. However , there are a couple of them where my son is jumping up and down wearing his underwear, and t-shirt. I wouldnt worry so much, but there are a bunch of perverts out there that I dont want them to get an idea. She has their names posted with them and her hometown, which is very small. Everyone knows everybody and it wouldnt be a problem to find out where we live.

They can post the pictures unless it is in violation of a court order or if the picture were of a type to cause prurient interest of another.
