tree roots damaging condo neighbor's patio

What is the name of your state (only U.S. law)? California

I cannot find specific information on this issue in our CC&R s.

The very large tree in the backyard of our condominium (designated, "restricted access common area" space) has very large roots which have damaged the neighbor's cement patio. The patio was built originally by the builders. Whose responsibility is it to fix the patio? The HOA thinks it is our responsibility, our real estate agent who sold us the property thinks it is the neighbor's responsibility and the neighbor thinks it is the HOA's responsibility.

**A: who planted and maintains the tree. It appears that the tree is in a limited common area in which you would be partly responsible for.
