we are a MA company also doing business in NH. NH employee went on short term disablity. employee responsible for portion of health benefits, reimbursed through payroll deduction. as he is currently not working, no deduction can be taken. advised him that he needs to reimburse via payment. we have not terminated him as of yet. can we? if so, can we cancel health benefits retroactive to disability date and offer him COBRA? any other options?
