What is the name of your state (only U.S. law)? Ohio
I have a rental (condo - 3rd floor apartment style). Recently the tub drain in one of the baths leaked and caused some damage on the 2nd floor and a lot of damage on the 1st floor. My insurance company says that I am not liable for the damage (as I did not do anything to deliberately cause the leak). The owners of the 1st floor unit are livid and threatening to sue.
My recollection of the rules of the Association is that the association is liable for anything up to the dry wall and the owner is liable for damages dry wall to dry wall; including leaks and other plumbing/electrical problems.
In your opinion who is the liable party for the damage.
