Condo Window Replacement.

What is the name of your state (only U.S. law)? MA

In our condo of 100 units there is an Assessment to replace the windows & sidings of all units.

As per the Master Doc's the Window Casings are the responsibility of the association and the moving parts of the window and glass are the owner’s responsibility.

The current windows come as a single unit. So our board made a decision that 50% of the cost of the window replacement would go to the owner and 50% would be association’s responsibility.

1. Can the board make such decisions on the % of share without a vote?

2. Since the cost of the moving and non moving components cannot be identified, Do I have the right to ask that windows should be made as 100% responsibility of the owner so that the owner can replace them with a vendor of his own choice and at 1/10th of the price than what association is planning to charge

**A: yes, but that is not realistic. The better idea would be to make the windows 100% common element and get all the windows done at the same time.
