I was told the issue of selective enforcement of CC&Rs (Covenants, Restrictions, etc.,) is actually consumer law. Can you tell me, then, if an approval on an open space common area encroachment given 10 years and now being rescinded constitutes selective enforcement when other property owners with similar encroachments are not having their permission rescinded? It is a retalliatory action against me by my HOA, and I also feel because of the prior approval it constituted a waiver of the CC&Rs which after this time frame would be wrong to rescind. thanks very much!
