When is a spouse entitled to a portion of retirement account? The couple has been married less than 5 years and wife is wanting a portion of retirement and deferred compensation account. No children from this union. I have been told that a couple has to be married for 10 years but have been unable to find out for sure. What is the name of your state (only U.S. law)?

Whatever portion of the retirement that accrued during the marriage is marital property and subject to division between the spouses. There is no length of marriage requirement for this.
