HAD BEEN GONE FOR 3.5 DAYS WHEN A SEARCH WARRENT WAS DONE @ MY GIRLFRIENDS APT..SOME "BAGS WITH RESIDUE WERE FOUND IN THE MASTER BEDROOM AND CLOTHING ROOM.I WENT BACK LONG ENOUGH TO GRAB THE PAPERWORK LEFT BEHIND AND TO MAKE SURE THINGS WERE LOCKED UP WILL/CAN ANYONE BE ARRESTED AND CHARGED FOR THE EVIDENCE?SKAGIT COUNTY, WASHINGTON ST.

Generally the law requires that the amount of drugs possessed be a usable quantity. If the residue in the bags could not be considered a usable quantity, then there should be no charges. There is no problem with executing a warrant when you are not there. If contraband is found, the prosecution would have to tie it to you at trial.
