Please read over this and tell me what I could do I live in Illinois, and worked for Circuit City I was fired from my job for telling a girl what someone else was saying about her. Thank You in advance if you assist me it is very much appreciated. Here are the conversations that happened. To begin I just want to say that a guy named Brian was the one telling me everything. When the human resource guy called me I confessed his name. It is strange how I got fired and nothing happened to him. Can I sue the company for wrongful firing of me or anything like that? I was a good worker I had never been wrote up for anything. Another thing to keep in mind is that Lei was only a representative she was there for a couple of days only. I do have people to testify on the facts of these conversation if needed.


Conversation 1:

Situation:
Multiple Associates in the location of the DSL stand. On February 9th 2001

Lei – Want a T-Shirt?
Me – Sure… “Want D.S.L.?” an acronym… I can think of some things that can stand for…
Lei – Me too…
Someone in the group – Like What?
Lei – “Want D!ck Sucking Lips?”


Conversation 2:

Situation:
Lei, Shannon, Rick, and me talking together on February 10th 2001. I was just informing Lei about something that was told to me. And I felt that she should know about what people were saying about her.

Me – Hi, I was hearing rumors about you from someone else.
Lei – Like what?
Me – Well Like you were in a porn…
Lei – Noooo (laughing) I wasn’t in a porn (small friendly tap on the my shoulder from her), I have been in a couple movies though… I am going to be in this movie that is similar to “Sex in the City”
Me – Oh ok so that explains it you know how the telephone game works we learned in the 5th grade where you tell one person something and by the time it has reached the end of the line is totally different than the first statement made.
Lei – Yeah I know…
Me – Those type of movies are dumb anyways they have no true purpose.
Me – So what kind of movies were you in?
Lei – Mainly martial arts movies…
Me – That’s cool I took Shaolin for a long time so what type of art did you study.
Lei – I took Tae Kwon Do and Karate.
Me – Mainly point arts, no combat… (I was signaling to areas of the rib cage area of the body where a person would normally hit) (Lei then tapped me in the area of the rib cage, just confirming where a person would normally be hit)
Lei – Yeah they are kind of weak… So who told you about the movie?
Me – I can’t tell you I am sorry it wasn’t me though that started the rumor I was just telling you about it…

At the end of the conversation Lei did not appear offended…



Conversation 3:

Situation- Me and Shannon talking…. I was basically just informing Shannon of the other rumor being spread about Lei.

Me – I also heard something else about her.
Shannon – What?
Me – That her boyfriend is her bodyguard
Shannon – He is…
Me – And that he is paid to walk around with her and sleep with her.
Shannon – (Laughs)
Me – I didn’t start any of it…

I constantly told Shannon that I didn’t start it, I was just hearing things from others.

Conversation 4:

Situation – Shannon and Lei… right after I walked away and Shannon was still laughing Lei approached her and asked her what she was laughing about…

From what I was told this is how their conversation happened…

Lei – So what did he tell you?
Shannon – That your boyfriend gets paid to sleep with you.

Lei seemed offended and left, from what it seemed she left due to the second rumor that was told to her.


My Points On The Matter:

1. I just informed her of a rumor being spread about her at the work place and I made that clear to her in the very beginning of the conversation.
2. I didn’t start the rumors.
3. If someone was told a rumor are you mad at the person who started it or the person that told informed you about it?
4. She seemed offended by the second comment that was told to her, which I didn’t have anything to do with except that I was, one portion of a multiple part chain of individuals.
5. Why am I being singled out? Is it because I brought up a sexual comment in the work place to a person? Didn’t Lei do the same thing? Didn’t Shannon do the same thing to Lei? And most of all didn’t Brian the guy that told me everything… why didn’t he get in trouble. And their comments were worse than mine, not only in my opinion but also by many others.
6. What did I truly do wrong? Whatever I did wrong is no more than what a minimum of 4 people did wrong (Shannon, Lei, Brian and I guess me). If I am in trouble for spreading the rumor or even having a conversation about he rumor then the whole store should be in trouble including a member of management. Expecially after further review of the Circuit City Sexual Harassment Policy (second paragraph last line) “Sexually oriented remarks or comments made about other associates, even when they are not present, are prohibited.”
7. I was the only person fired… Nothing happened to anyone else…


Here is the policy I got fired for… by the looks of it I was just an escape goat or something.

This company is committed to provide a work environment free from all forms of discrimination and disrespect, including sexual harassment. Sexual harassment in any of its several forms is improper and unlawful conduct, and the company will not tolerate its presence in the work place. No associate, male or female, should be subjected to unsolicited and unwelcome sexual overtures or conduct, either verbal or physical. Sexual harassment refers to conduct which is offensive to the individual, or harms morale, or interferes with the effectiveness of our business. Such conduct is prohibited. Examples include repeated offensive sexual flirtations, advances, or propositions; continued or repeated verbal abuse of a sexual nature; explicit or degrading verbal comments about another individual on his or her appearance; the display of sexually suggestive pictures or objects; or any offensive or abusive physical conduct. Repeated foul language or sexually oriented jokes, remarks or gestures may often be offensive to another associate, and thus should not occur. Sexually oriented remarks or comments made about other associates, even when they are not present, are prohibited.

Sexual Harassment may also include the taking of or the refusal to take any personnel action on the basis of any associate’s submission to or refusal of sexual overtures. No associate should even imply that an individual’s “cooperation” will have any effect on the individual’s employment, assignment, compensation, advancement, career development, or any other condition of employment.

Sometimes there can be a fine line between a bona fide social relationship and what could be construed as sexual harassment. In general, social relationships involving a boss and subordinate create a conflict of interest and may result in discipline of the senior level member of the couple, up to and including dismissal; and, thus requires senior management knowledge and approval.

Sexual harassment in any form will not be tolerated. If you feel you have experienced, witnessed or are aware of sexual harassment in the work place, you must immediately notify your supervisor or a member of the personnel staff so that management can take appropriate steps toward correcting the problem. Please be aware that the sooner you notify management or personnel, the more effective we can be in correcting the problem.
