What is the name of your state (only U.S. law)? New York
Me and my boyfriend bought our first car, a 1999 Dodge Caravan on May 4, 2009. When we went and looked at the vehicle, I noticed that van did need new tires, however, I asked the seller if it needed ANY repairs (major or minor)? Her response was "No, the vehicle is in great driving condition". Once able to have it registered, we took it to Monro Muffler, who told us it needs $1500 worth of work just to pass inspection! Once they told us that, I knew she didn't have the car inspected because she bought the vehicle in March of 2009 and the inspection sticker on the vehicle is from December 2008. The reason she didn't have it inspected is because it wouldn't pass with the problems that existed. However, the seller left the country almost immediately after we purchased the car. I e-mailed her and asked if she could just send back $500 for us to put towards repairs. She responded with "No I will not and if you want the money that bad you will have to take me to court"..."and because I am not in the U.S. anymore, you can't sue me". She also proceeded to tell me in the same e-mail that she took the van to Meineke and they told her it needed brake work and new tires and she thought they were trying to cheat her out of her money and she was aware of the problem. So, technically, she knew the problems existed and didn't tell me until the e-mail yesterday. Everyone that I have spoke to said there is nothing I can do because she left the country. So you mean to tell me, that because she left the country, I don't have any rights as an American to sue her for a probable cause? I have more than enough evidence to have a strong case.
