What is the name of your state (only U.S. law)? Pennsylvania
Our board is split on the issue of how much responsibility can be required of unit owners on common property, especially landscaping. Our condo is one of attached and semi-attached patio homes and townhomes; each has landscaping to the front and some on the sides as well. All landscaping is on common property. There is no designation of limited common elements in the builder's filed plans.
Is it LEGAL in PA to tell the adjacent unit owner he must be responsible for the maintenance of the landscaping, including weeding, feeding, spraying for bugs, fall cleanup (removing after-season dead plant matter) or replacing any plants that die? If it is legal, does the Board have the authority to make this decision, or must it be, for instance, a majority vote of the homeowners?
Our problem is that the voting majority of board members PREFER to do this type of work themselves. Others in our condo are physically incapable of doing it, and others bought condominiums instead of private houses simply because hey did not want to be bothered with outside maintenance.What is the name of your state (only U.S. law)?
