What is the name of your state (only U.S. law)? Michigan. Our site condo shares a lake with private owners and the state of Michigan. The lake is listed as a "no restrictions" body of water, and has a state access ramp. The board, (which would like to limit traffic on the water), would like to pass a rule forcing us to screen our vacation renters based on their intent to use this lake, ie., placing a statement in our rental agreement, stating that "no jet skis are allowed". A lawyer on the board claimed he could produce "case law" in support of the rights of the condo to control renters in this way, and the conservation officer didn't contradict him. Even if it was legal for us to discriminate in this way, would it be legal for the condo to force us?
