What is the name of your state (only U.S. law)? IF YOU WERE GIVEN MONEY AS A GIFT AND THE PERSON SAID IS WAS A LOAN AND TOOK YOU TO COURT (BUT I NEVER SIGN ANYTHING SAYING THAT IT WAS BECAUSE IT WAS A GIFT). WHAT LEGAL RIGHT WOULD I HAVE OR WERE DO I STAND IN THE LAWS SIGHT. i LIVE IN NEW YORK.

Drop the caps.

It depends on what the court believes in the testimony .

Lets say the gift/loan was for $50.00 .

The court may be inclined to believe it was a gift .

Let's say it was the max amount to sue for in NY .

Depending on the testimony ,the court might go either way .

It would also depend on other factors .

Use of the person's CC ,etc.
