What is the name of your state (only U.S. law)? CA
I let a family member borrow some money to pay for their business truck insurance I have the receipt. However, since then they filled personal bankruptcy but did not include the business. Can I take them to small claims I didn’t have them sign anything but I have the receipts for the transaction and my credit card statement this was over one year ago.
 


If this was a personal loan to them, then you will need to make a claim in Bankruptcy Court. If your loan was to the business then you sue the business.

My first impression is that this is a Bankruptcy claim though.
