i reside in california.
is an employer being discriminatory if they pay one terminated employee severance and not another? is there any presidence set by paying one severance upon dismissal?

Severance pay

Generally speaking severance pay is not required to be given by private employers. The exceptions are if the employer is unionized and severance pay is in the contract. Or, if it is not unionized, employee's contract of employment requires it. Finally, I would not say that a court would conclude that by the employer paying one employee severance pay versus another employee, that the employer has created a precedent that it must follow with all other employees who are terminated.
