I am about to file a small claims action against a local car dealer for repair work deficiencies (very poor workmanship, replacement parts needing replacement, etc). The dealer has several new and used lots in CO, may be in other states. Who do I name in the complaint? My service advisor, the mechanic(s), the dealership? The catch is that they have 2 locations here in town, one did the initial repair work, the other I had inspect and subsequently repair the initial repairs. Any help is welcomed.

My response:

You name the dealership, only.

Then, you find out who is the "Agent for Service of Process" on the dealership, and have the papers served on that person.

My response:

Okay, now you turn your Summons, Complaint, and all other necessary papers that you got from the court, over to an "Attorney Service" company, to complete service of process on the dealership. Look in your Yellow Pages for one, or call a local law office and ask for the name, phone number and address of the Attorney Service they use.

Then, you pay the attorney service to:

1. Locate the Agent for Service (separate fee); and,

2. To actually serve the papers (separate fee).
