I live in Georgia.

Our vehicle has been in the shop for over a month. We paid the shop owner $950 for the parts from a wrecker. THe owner keeps giving us excuses as to why the vehicle is not ready. He claims one of his workers damaged a part, or he says replacement parts have hipped and then they don't arrive, or he says the parts are damaged and he won't use them... and so on... He also tells us he will keep us updated but then does not answer his phone most of the time and he rarley returns our calls after we leave a message. He always gives us a story when we drop by to get an update.

Do we have a case that we can win if we sue him?

Sure you do.

But if it were me, I would go straight to that repair shop (with a police escort, to keep the peace), bring a tow truck (or flatbed, depending on the condition of the vehicle), demand a refund of the money you paid out for parts never received, and take your vehicle to another repair shop to have the work done.
