The policy states that fees 90 days or more deliquent are subject to legal collection. I am 42 days and was served a legal notice.

What are you delinquent on, and why haven't you paid it?
 
Was it a warning letter telling of the legal actions that are going to be taken, or was it the actual letter telling you legal action has begun?

Saying you received a "legal notice" is quite vague. Having the Association Secretary mail you a certified letter is a type of "legal notice." Please be more specific.
