I was just wondering how long a private process server has to serve you before the actual court date. A friend of mine got served tonight 10/16/2009 for a small claims suit from a bank with a court date of 1 week from tonight 10/23/2009. The date the suit was filed is 09/22/2009. The server sat on this for nearly a month and now gave him a week. He needs at least 2 weeks notice to even request off? Can he file a motion for a continuance based on the server's slow delivery?
