What is the name of your state (only U.S. law)? Illinois

I live in a 40 unit condo. Our Declaration document states in part that "...each member of the Board shall be one of the Unit Owners and shall reside on the Property...". Further "...units owned by corporations and partnerships may have an agent serve on the board so long as that agent resides on the property."

One current board member lives in a home he owns in a town 40 miles away, works in the town where his house is, has his condo real estate tax bill sent to the other house, and spends one or two weekends per month in his condo here.

Another board member lives most of the time in Florida, has Florida plates on his car, and has his condo real estate tax bill sent to another address besides the condo here.

Do these two board members meet the "reside on the property" rule?

Depends on what "reside" means. Does it means 30 days out of the year? 6 months? or full-time?

The rule of thumb on this is that if it does not specifically state otherwise, you must go by the "letter" of the law. In this case, one of the Board Members resides there every other month.

If it bothers you, run against him at the next election!
