I own a temporary staffing service in Tennessee and fired my sales manager after 30 days on the job for poor performance. We do not have a contract and I haven't written an employee handbook yet. I am a new company, less than 90 days old. Out of the 30 days of employment the former employee wants me to pay her for 4+ days she missed for having surgery and a sick child. We did not agree on being paid for time not worked in the first 90 days but she says that because she is a salaried employee she is entitled to pay whether she worked or not. Please tell me what the law says I have to do. Thanks
