What is the name of your state (only U.S. law)? Massachusetts
I live in a condo association where the site plan shows five spaces of equal size - one for each unit and one guest space.
There is a disagreement about the parking situation. Some feel that there is more than enough space to park cars tandem and others do not.
What are the governing documents in this situation? If the unit deed and the master deed say that each unit have one space each, what legal standing does the P&S have if the P&S actually says that the unit purchased tandem parking? If the P&S had that declaration, should the Unit Deed reflect that? Does the site plan that shows the "approximate" size of each space have any standing?
While the parking situation is an annoyance and a nuisance, really trying to avoid adverse possession or the unit owner selling with two deeded spaces.
