What is the name of your state (only U.S. law)? California

Hi, I hate we have to met under these circumstances.

My daughter was arrested Friday on 9cts of embezzelment and 9cts of passing checks. She worked at a cash advance place that does payday loans. Her arraignment is tomorrow. 22 yrs old first offense. Should I have an attorney with her on tomorrow? I guess what I want to know, is the work case scenerio. The money she is being accused of stealing about 3,000. Any advice for this first time mother going through is would be greatly appreciated

If your daughter cannot afford an attorney the court should appoint one to represent her at her arraignment (which, I assume is the hearing tomorrow).

She WILL need an attorney.

The WORST case scenario is prison. The most likely outcome is some county jail time, probation, fines, and restitution to the victim.

yes, she should have an attorney. actually, she should have had an attorney already set up to look over the case instead of waiting till the day of the hearing.

she may be able to request a continuance in order to be able to obtain an attorney.

sorry for confusion

She has an attorney for tomorrow I hired him yesterday. Is it a possibility they will O.R her. I know the attorney a plus. Just wanted some real life expereince. He talked to her and did say her bail will most likely be dramatically reduce. Im so sorry for the lawyer comment. Im so nervous and broken behind this I don't know what Im saying. He told me she could be released, but of course can't guarantee.

Apparently, she was writing checks on her own account and was trying to pay them back, but it all snowballed. It was 11cts on both the embezzelment and the passing checks, but they found out she paid those back

Have there ever been a case of this matter where someone was released on arraignment day?

Sure she could get released. If the judge imposes bail and she's able to meet the bail requirement she'll be released pending further court appearances.

Thanks for all the responses. Highway her bail currently is 180.000, so u can see why she stayed the weekend in lockup.

I had to make a difficult choice to retain attorney or make bail. So even if she can bail out, I don't know if it can be that dramastically reduced for me to pay max 2,000.

My consideration was to wait for next court date when they probably release her anyway (not without the issue being completly resolved)

You know what. Whatever God allows to happen will still turn out for her good. Im not just babbling. Her "action" required consequences. I told her this is her one and only get out of hell card with her mother.

So I will just take my chances with God, because in the end it will work out for her good no matter what tomorrow brings.

I can guarantee one thing, she won't do this again. She has spent 3days in city jail and she is depleted.

Thanks for listening and responding. I have never been through anything like this.
