What is the name of your state (only U.S. law)?
South Carolina

My wife had someone hit her car, police report states other person ran a red light.
We will be having the car repaired, its not a total

Now now that this car has had an accident, the real market value will be less because it was involved in an accident.

Can we sue the individual for the difference of the before and after market value- Diminished Auto Value ????

You can attempt to file a claim with their insurance for diminished value, to the extent that you can get documents to prove it.
