What is the name of your state (only U.S. law)? ohio

If a person applies through probate court for a conservator of the person only asking for assistance in making decisions of a specified nature,

and,

An attorney referred by the Probate Court accepts the appointment as conservator, recording the acceptance with the court, and signed by the Probate Judge,

Can this be considered a contract between the parties?

If not, then what essential elements of a contract are missing?

If it is a contract and the contract is breached, can the breach be litigated?
