i am in texas.

i want to start my own magazine publication, but i don't want anyone else to be able to use the name while i'm in the process of starting up and before or after it's published. do i need to make it a trademark? copyright? i don't even know how to begin.

If you are the first to use the name, you will automatically have a trademark on the name within the geographic market area in which you use the name. To have the right to the trademark on the name everywhere in the country, including markets you have not actually been in, you must register your trademark.
