What is the name of your state (only U.S. law)? South Carolina

There is a non-profit agency and the Executive Director misused gov't funds. The finance staff reported her and was protected under the whistle blower act. She did not go to prison...So the finance staff filed a lawsuit against the Executive Director and the Board of Directors. The finance staff won the lawsuit. Guess who paid the penalty fees to him.....the Agency (the victim). Do you know why? One of the Board of Directors named in the lawsuit is now the new Executive Director of the non-profit agency. Is this legal? Is this right? What else can be done? Who can take a second look at this situation?
