my finance' received a phone call that he was being let go due to down sizing (odd they just hired a new employee), then two days later he received a note via e-mail, from home office that his x-supervisors e-mail of "let go due to down sizing was being changed to with cause". we are confused, he has received no notice or signed any reprimand for cause. he has an impecable service record. something needs to be done. please help. thanks jferrara, state of florida.

They changed the termination to "for cause," so they could oppose him receiving unemployment compensation. By saying "downsizing" he would have qualified for unemployment.

When an employee collects unemployment, it effects the rate that a company pays to unemployment insurance. The more people collect, the more the company pays.

Employers are also opposing receipt of unemployment compensation because they are afraid that if, down the road, someone who was terminated decides to sue them for something, then because the State said they were eligible for unemployment compensation (which eludes to the company doing something wrong), they would have a better chance with their lawsuit because the State, by paying unemployment, says the person became unemployed through no fault of their own.

If you are refused unemployment, appeal it immediately. Then find an attorney to attend the appeals hearing with you. Make sure you take all your records -- awards, certificates, memos of a good job your doing, whatever positive you have.
