What is the name of your state (only U.S. law)? Texas


We have a floor covering store in a little shopping center next to a competiors warehouse. We put a advertising banner on our roof facing our competitors parking lot. Our competitor then rented a big truck and parked it in front of our banner. They even stacked pallets on top of the truck to block our sign even more. Is this legal? What advice can i get on fixing the situation?

If the truck is on their property, there is nothing you can do! If it's in your shopping center's lot, have the property manager have it moved. What are signage laws like in Texas? Did you need a permit for your banner?

It is too bad this other shop doesnt see the risk they pose to them selfs of being sued should winds cause the pallets to topple over onto another parties car or a person and injure them , Do self a favor and take pics of the truck and include the license plate of the truck and have the photo shop date them so if by chance any of your customers are injured the pics will be available , Also if this lot is owned by your LL send to your LL copy of the pics and letter suggesting they save the pics because if someone is injured fair odds are that a injured party might attempt to include them in a injury suit. If at the very end this other shop will not correct the condition they created , do research with city ords on this next suggestion first and if its permitted speak to your LL about you having a professionally made and installed framework to hold a new banner to installed on the roof at your expense , giving you exclusive rights in writting to use it for the duration of your occupancy and suggest to your LL that this framework someday after your gone would give them something they could rent to others to increase cash flow once your no longer using it. If all goes well then have a atty draw up a lease amendment that will protect your right to use it and offer it to the LL for signature before installation.
