Court commissioner said - when asked for an ex parte writ of attachment - "we don't do those here" HUH??? My attorney has done lots of them in LA County. I'm in Orange County. Is there a special formula for this particular court? Facts of the case: Sis and I are suing Caregiver who absconds with artwork, cash, vehicle, stating these things were given to him before my father died. We have photographic evidence showing the items were still in the house on a certain date. Caregiver, in his sworn statements siad he was given the items BEFORE that date. Liar. Caregivers attorney recently suggested during conference with our attorney that the lawsuit would be long and expensive and that the money could be gambled away and nothing would be left. Thus the need for ex parte relief and a writ of attachment. I would much appreciate some help from anyone who has dealt with this in OC Superior Probate court.
