Is it advisable to attempt recovery of my unpaid wages ($3000+), and how?

Details: I worked as an engineer for an engineering firm in New York State. The firm was selling its invoices to a creditor (in order to get cash) and was into heavy debt. The firm was the only asset of a holding company, which was publicly traded. The holding company existed only on paper. The firm closed because it could not pay its employees. The firm has yet to declare bankrupcy. The creditor seized the firm's assets, collected outstanding bills and refuses to pay the employees.

Who owes me money? the creditor? the holding company's major stockholders?
