when a stae agency takes custody of an elder because the husband is deemed incapable of properly caring for his wife at home and the nursing home where she is taken is so short staffed that they feed her too fast and too much causing her to choke and results in a visit to the hospital ER by ambulance where the guardian attorney is unavailable and the husband has to authorize emergency care to prevent death, how can the old man (husband) hold the state responsible if no attorney is willing to take the case?
