What is the name of your state (only U.S. law)? VA. Will my mothers 12000 dollar credit card debt hold up the transfer of her home to beneficiaries? The home is the only asset except her IRA and life insurance. What advice can any of you all give me. Thanks.What is the name of your state (only U.S. law)?

unless the home was titled as joint tenants with the beneficiaries, yes.

the debts of her estate need to be paid before determining if there are any assets that can be distributed. If the house is the only asset of the estate, then it may have to be sold to pay the estate debts.

Or, if a single beneficiary would get the home, they can pay off the creditors by "buying" the house from the estate using a purchase money mortgage sufficient to pay off the creditors.
