What is the name of your state (only U.S. law)? New York -- Can the LLC paperwork name me as the 100% owner and the operating agreement name me as 59% owner with additional partners for the other 41%? Would the IRS then treat the LLC as a sole proprietorship? How would that affect the LLC members named in the Operating Agreement? Would the members be treated as consultants for tax purposes?
