What is the name of your state (only U.S. law)?

California

I am starting a new company but I have not been incorporated. What happens if someone decides to use the same name I use and incorporates their business? Will I have rights to it?

Only in your own mind. Why in the world would you think that your just THINKING about a business name would somehow 'reserve' it??

I am not just THINKING about it. It is my DBA, though not officially recognized.

Also, should I tell clients to write checks to me or to this DBA I have. Thanks.
