What is the name of your state (only U.S. law)? Illinois

My ex husband passed away several years ago and left life insurance to my minor son, so I have become the guardian of his estate until he is 18. He is currently attending private school and I was wondering if I would be able to use some of this money to pay for his education. If so, do I have to petition the probate court first, or do I just provide the receipts at the annual hearing?

My expertise is in NYS probate, but many states operate in a similar fashion. In NYS you would have to file a petition to withdraw funds for support and education. In NYS that would be under Surrogate Court Procedure Act 1713.
