INDIANA**************.When a Drug Task Force receives anonymous tips via a Tipline and then further communicates with the tipster via email & cell phones to gather more information about the suspect and crime and tells the tipster that everything will be kept confidential, what will be included in the MOTION FOR DISCOVERY?

That depends on what is asked for in the motion.

I imagine the defense will receive all the reports prepared by the law enforcement agency but will likely be able to conceal the identity of the informant. In those instances I have worked and known about, the informant is generally not identified unless the court orders it and then, in some cases, the prosecution might drop the matter in order to protect the informant.

However, in tip cases, because they may not qualify as a "reliable confidential informant" we often use the tipster for clues and information and do not rely on them for evidence. The tipster points us in the right direction and we gather the information independent of the tip. Now, if the tipster does a controlled buy, or tapes a conversation or a phone call that we use, THEN he or she may have to be revealed if we use that tape or other form of direct evidence provided by the tipster.

A lot depends on the details.
