What is the name of your state (only U.S. law)? Texas

My wife was charged with a 3 degree felony four years ago and received deferred adjudication. She is still currently on probation( for the criminal offense)in good standings. She has been employed with this company for the past 3 years and has worked her way up. She was recently told that she would be fired because of her background. The company was made aware of it prior to employment. The issue came up approximately 1 year ago , and she was advised by her immediate boss and company that there would be no issue since it was under deferred adjudication. She was recently told that by the HR dept that they have to go by there guide lines and it is not a reflection of her job performance. There are several other employees that are employed with the same company that are convicted of violent felonies and are retaining their employment. She was informed by her defense attorney that there is not a conviction for a felony. Is this discrimination? And is there any recourse if she is fired?

Sorry, I don't see any legal recourse. Her situation is not protected by employment discrimination laws and therefore, the employer can pick and choose who it retains and who it lets go, the difference in crimes or misdemeanors or punishment not withstanding.
