I have an employee that I think is going to give me her two week notice. I believe it will be a verbal resignation.

1. Can I ask her to sign a letter of resignation?

2. At the same time can I accept the two week notice and tell her that I would like her last work day to be today but I will give her pay eqivialant to the two week notice that she is giving me. (I have even written it out for her to sign) Is that legal? Can she sue us for me asking her to leave once I get the resignation even though I would be giving her the two week pay that she would earn if she worked. I would also give her any vacation time she earned up to that point.

3. How do I tell her I want to see what she takes from her desk?

1. Yes. Make it a form letter and keep it in your desk, she may present you with a written resignation, but if she doesn't, present the form letter, have her write in her name and sign it. Give her a copy.

2. Yes it is legal as long as you pay her. No she cannot sue if you pay her as though she was working.

3. If you have some type of security it is best to let them accompany you and her to her desk, give her X amount of time to gather her personal items, then escort her off the property.

The situation you describe is not uncommon in this era of sensitive information and computers, and this is the way I've seen it handled. You are being fair, and provided you treat her with respect you are well within your rights as an employer.
