I was charged with one count of sale of sch.II(morphine),hired a $7,500 lawyer,went to court,on my plea date,i already got my discovery,but they only sent the written part ,no audio,so i stood up in front of judge and asked him if i could hear the tape,he said talk to my lawyer,my lawyer said it is within the d.a.'s rights, to withhold the tape, unless i refuse the plea agreement,is this true?

No,i want to know if it is legal for the district attorney to withhold the audio tape,unless i refuse the plea agreement,and go to trial,then he says i can hear the tape,but ive already filed my motion for discovery and it came back,but it was only the written part,no audio...i thought my discovery should be any and all evidence against me...not just the parts they want me to get,so the only way i could take a plea agreement was to not hear the tape,or take it to trial and i could get four years t.d.o.c. instead of four years t.d.o.c. suspended to six months in county jail and three and a half years probation.i found out later my $7,500 lawyer was best friends with the d.a.! :confused:
