What is the name of your state (only U.S. law)? Texas Law.
An employee was fired due to he was arrested for an investigation. He spent 3 days in jail, and didn't have enough time to cover it. He was released with all charges drop. With this being an investigation that didn't involve him, and he didn't have no choice to go to jail when police arrive at his house. Can the employer fire the employee for not having time to cover.

Can the employer fire the employee for not having time to cover.

Absolutely. Why on earth would you think otherwise?

Agree, no wrongful termination here. As cbg asked, why would you think you couldn't terminate him?
