What is the name of your state (only U.S. law)?
Indiana

Deceased brother's resident state was Indiana and he died (without a will) :cool:in July of this year.
4 family members survive. 2 sisters, a brother and our 96 year old mother. She is still 'somewhat mentally/physically competent, she is not 'capable' nor does she have the knowledge and capacity to represent the estate affairs of our late brother. However, she intends to submit an application to represent the estate in court, (simply because she is the mother) but does not want to pay an attorney to help her, and since she doesn't know 'what' to do, she has, so far, done nothing. Does she or any one of the 4 survivors need the concurrence of the other 3 to have the application to represent granted by a court?
