in california there is a clause in the law that states an injured worker may waive workers comp and sue the employer for damages caused by their negligence-how do I go about this? can I use my workers comp attorney for this or do I need to retain another attorney? also can I wait to find out the outcome of my workers comp hearing before I legally pursue the issue of their negligence?
