Will this case hold up? The loan was with a minor

Hello, My husband co-signed for a loan with someone who was 17 years old at the time of the loan. 2 months before his 18 birthday. He default on the loan and we paid the majority of it. Can we take him to small calims court? Will it hold up? I live in Ohio. Thanks for any help.
