What is the name of your state (only U.S. law)? Illinois

My question for you guys is this, my father just passed a couple of days ago and i'm the POA (but it was only health related). He rented an apartment and I need to get everything out. My question is do i call an auction? Or are there any other options that you can think of that would be better or am i even able to do this. Does the state still come in if he didn't own any property?

You don't say much about:

1) your father's assets
2) whether he has a will or not
3) a spouse or other children

In theory, you have no authority to do anything. In reality, unless there is someone to stop you...

Judging from what you have stated, your father does not have much in the way of assets. If it is needed, Illinois has a small estate process for estates under $100,000 in value. Google "illinois small estate affidavit".

Does the state still come in if he didn't own any property?
The state does not "come in." Unless the state is owed money, the state could not care less, even if there is real property involved.
