A paralegal quits the firm of Johnson & Johnson. When she leaves, she takes client documents she prepared while at the firm. The documents contain confidential client information. The paralegal is showing these documents to potential employers as writing samples.

What is the ethics of getting others to do your homework for you? Oh yeah. It is not ethical. It is cheating.

  • Attorney's at Johnson & Johnson should file criminal charges for larceny against the thief
  • Attorney's at other firms should testify that thief was in possession of stolen property
  • Thief should go to jail for larceny.

Would you care to explain the purpose of your post considering that California has never adopted the ABA’s Model Rules of Professional Conduct, and that there is nothing comparable to Model Rule 5.3 (2004) in California’s own rules of professional conduct.

Or are we to assume that part of this hypothesis of yours includes the state’s adoption of the ABA format?
