When our father died over 30 years ago in Calif, we 4 children received equal shares in his will. I, and 2 of my siblings, have served as the Trustees for our brother who lives alone and functions ok but is of "borderline IQ; hence his share was treated as a trust according to my father's will.
What is not clear is what happens to our brother's funds if any or all of his 3 trustee siblings outlive him. Do his funds revert to the state or do they automatically go to his next of kin, which would be his 3 siblings, as he never married or had children? If not automatic, could he write a will that explicitly states such distribution of his assets equally to his sibs upon his death?What is the name of your state (only U.S. law)?
