I was arrested and charged with a class d felony because my previous employer said i was paid in advance for vacation and sick time and cleaning the office. i was charged with theft by deception over 500, is this legal??

did you refuse to pay back money you were paid but not entitled to?

If you intentionally asserted you earned wages that you did not, that could be considered fraud (larceny), yes.
